OpSpec/MSpec/LOA D073, Approved Inspection Program (AIP)

1.    Purpose of This Notice. This notice revises the operations specification (OpSpec)/management specification (MSpec)/letter of authorization (LOA) D073 templates for operators conducting aircraft operations under Title 14 of the Code of Federal Regulations (14 CFR) parts 91 subpart K (part 91K) and 125 (including part 125 Letter of Deviation Authority (LODA) holders). This is a mandatory revision to OpSpec/MSpec/LOA D073. This notice provides revised guidance for Federal Aviation Administration (FAA) certificate-holding district offices (CHDO), principal maintenance inspectors (PMI), and principal avionics inspectors (PAI) assigned to operators conducting aircraft operations under parts 91K and 125 (including part 125 LODA holders).

2.    Audience. The primary audience for this notice is FAA CHDOs, PMIs, and PAIs assigned to operators conducting aircraft operations under parts 91K and 125 (including part 125 LODA holders). The secondary audience includes all Flight Standards divisions, branches, and offices.

4.    Explanation of Changes. The Aircraft Maintenance Division (AFS-300) has revised the D073 templates and guidance for parts 91K and 125 (including part 125 LODA holders) after receiving comments regarding unclear guidance in FAA Order 8900.1, Volume 3, Chapter 18, Section 6, Parts D and E Maintenance Operations Specifications/Management Specifications/Letters of Authorization, and issues with the D073 templates. The guidance now correctly addresses the application of D073 for parts 91K, 125 (including part 125 LODA holders), and 135. This revision standardizes Table 1 requirements and revises the language used in each 14 CFR‑specific template to better reflect the regulatory language used in each applicable part of the regulation.

5.    Guidance. This notice contains the following:

    The sample MSpec MD073 template in Appendix A applies to part 91K.

    The sample OpSpec D073 template in Appendix B applies to part 125.

    The sample LOA D073 template in Appendix C applies to part 125 (A125 LODA holder).

6.    Action. This is a mandatory change affecting Airworthiness principal inspectors (PI) responsible for issuing and amending OpSpec/MSpec/LOA D073. PIs should provide this notice to the operators for whom they are responsible. Affected operators must be issued the revised D073 within 90 calendar-days of the HQ Control Date in the Web-based Operations Safety System (WebOPSS). No action is required for part 135 certificate holders.

Appendix A. Sample MSpec MD073, Approved Inspection Program (AIP): 14 CFR Part 91K

a.  The program manager is authorized under 14 CFR part 91, § 91.1109(b)(1) through (b)(5) to use the approved inspection program (AIP) in Table 1, provided:

(1)  Each aircraft listed in Table 1 is inspected in accordance with that program.

(2)  The program is in writing and derived from one of the programs listed under § 91.1109(b)(1) through (b)(5).

(3)  The program includes, at least, instructions and procedures for the conduct of inspections for the particular make and model of aircraft listed in Table 1, including necessary tests and checks. The instructions and procedures must set forth, in detail, the parts and areas of the airframe, engines, propellers, rotors, and appliances, including survival and emergency equipment required to be inspected.

(4)  The program includes a schedule for performing the inspections that must be accomplished under the inspection program expressed in terms of the time in service, calendar-time, number of system operations, or any combination thereof.

(5)  The program includes the name and address of the person responsible for scheduling the inspections required by the inspection program.

(6)  A copy of the program is made available to the person performing inspections on the aircraft and, upon request, to the Administrator.

(7)  The inspection program, including changes, is approved by the managing Flight Standards District Office (FSDO).

Appendix B. Sample OpSpec D073, Approved Inspection Program (AIP): 14 CFR Part 125

a.  The certificate holder is authorized under 14 CFR part 125, § 125.247(a)(3) to use the approved inspection program (AIP) identified in Table 1, provided:

(1)  Each airplane listed in Table 1—including its airframe, aircraft engines, propellers, appliances, and survival and emergency equipment, and their component parts—is inspected in accordance with that program.

(2)  The program includes instructions, procedures, and standards for the conduct of inspections for the particular make and model of airplane listed in Table 1, including necessary tests and checks. The instructions and procedures must set forth, in detail, the parts and areas of the airframe, aircraft engines, propellers, appliances, avionics, and survival and emergency equipment required to be inspected.

(3)  The program includes a schedule for the performance of inspections that must be performed under the program and expressed in terms of the time in service, calendar-time, number of system operations, or any combination of these.

(4)  The engine overhaul periods are specified in the program.

(5)  The certificate holder includes the program in its manual in accordance with §§ 125.73(n) and 125.249(a)(3).

(6)  The inspection program, including changes, is approved by the managing Flight Standards District Office (FSDO).

Appendix C. Sample LOA D073, Approved Inspection Program (AIP): 14 CFR Part 125 (A125 LODA Holder)

1.  The Operator/Company, authorized to conduct operations in accordance with the Letter of Deviation Authority (A125 LODA), is authorized under 14 CFR part 125, § 125.247(a)(3) to use the approved inspection program (AIP) identified in Table 1, provided:

a.  Each airplane listed in Table 1—including its airframe, aircraft engines, propellers, appliances, and survival and emergency equipment, and their component parts—is inspected in accordance with that program.

b.  The program includes instructions, procedures, and standards for the conduct of inspections for the particular make and model of airplane listed in Table 1, including necessary tests and checks. The instructions and procedures must set forth, in detail, the parts and areas of the airframe, aircraft engines, propellers, appliances, avionics, and survival and emergency equipment required to be inspected.
