SUBJ:

TSpec B005, Special Rule Curricula, and Continuation TSpecs B105 and B106

1.    Purpose of This Notice. This notice introduces and provides guidance on the issuance of training specification (TSpec) B005 and continuation TSpecs B105 and B106. These TSpecs authorize a Title 14 of the Code of Federal Regulations (14 CFR) part 142 certified training center to deliver curricula, curriculum segments, and portions of curriculum segments developed to meet specific training, testing, and checking requirements applicable to 14 CFR part 135 certificate holders. These curricula meet the requirement of part 135, § 135.341(d) as published curricula.

2.    Audience. The primary audience for this notice is Flight Standards offices, Training Center Program Managers (TCPM), Principal Operations Inspectors (POI), and associated inspectors assigned oversight of training centers that conduct operations under part 142, herein referred to as “training centers.” The secondary audience includes all other Safety Assurance and Safety Standards personnel.

4.    Applicability. This notice applies to TCPMs of training centers certificated under part 142 that request approval of curricula as described in Advisory Circular (AC) 142-1, Standardized Curricula Delivered by Part 142 Training Centers; and FAA Order 8900.1, Volume 3, Chapter 54, Section 3, Part 135 Standardized Curricula Delivered by Part 142 Training Centers, and Volume 6, Chapter 8, Section 1, Part 142 Inspections: Surveillance and Inspection Activities for Part 142 Training Centers, Satellites, and Remote Sites.

5.    Background. On January 21, 2014, the FAA established the Air Carrier Training Rulemaking Committee (ACT ARC) to provide a forum for the U.S. aviation industry to discuss, prioritize, and provide recommendations to the FAA concerning operations conducted under parts 135 and 142, specifically addressing air carrier training. The ACT ARC Steering Committee established an Air Carrier and Training Center Workgroup (AC&CT WG) and tasked it to consider strategies to improve part 135 certificate holder training and checking, including training and checking conducted by training centers. The AC&CT WG produced several recommendations to enhance safety, improve training practices, achieve standardization (where appropriate) and significant administrative efficiency gains in check pilot qualification, flight instructor qualification, and part 135 air carrier training curricula delivered by training centers.

6.    Discussion. To link the training, testing, and checking requirements to part 142 training center authority, the part 142 Final Rule included the special rule (refer to § 135.324) to establish minimum requirements for part 135 certificate holders that contract with part 142 training centers to conduct training, testing, or checking. The special rule defines the requirements that must be met for a part 135 certificate holder to use a part 142 training center. The part 142 training center may make available curricula designed to meet specific training and checking requirements for part 135 certificate holders after TSpec B005 and, as applicable, continuation TSpecs are issued.

a.    Curricula Authorization. The FAA has published several guidance documents to further consistency and to implement the ACT ARC recommendations for standardized curricula and other improved part 135 training provided by training centers. Standardized curricula and other curricula authorized under part 142 that are designed to meet specific regulatory requirements of part 135 will be authorized in a training center’s TSpecs. Order 8900.1, Volume 3, Chapter 54, Section 3 provides detailed information on the requirements leading up to authorizing the use of the curricula in TSpec B005 and the continuation TSpecs.

b.    Purpose of TSpec B005. TSpec B005 is used to authorize a part 142 training center to deliver curricula, curriculum segments, and portions of curriculum segments applicable for use in training courses required by part 135. B005 also authorizes the curricula for a training center to quality its personnel as instructors and evaluators (check pilots) under part 135.

(1)    The curricula, curriculum segments, and portions of curriculum segments referenced above are authorized in B005, and continuation TSpecs, in two tables. The curricula in each table meet the requirements of § 135.324:

(2)    TSpecs B105 and B106 are a continuation of TSpec B005. To avoid potential processing issues, TSpec B005 and continuation TSpecs should not exceed 40 pages each. These TSpecs must be used in sequential order. Issue the next sequential TSpec at or before reaching the 40-page limit for the preceding TSpec.

c.    Benefits. Use of TSpec B005 and continuation TSpecs will provide the following benefits:

    Provides authorization for training centers to make available curricula for part 135.

    Supports improved efficiencies for granting approval of training and qualification curricula that will be used as part of a part 135 certificate holder’s approved training program.

    Defines common instructor and evaluator (check pilot) curricula which eliminates the need for redundant check pilot approvals for curricula identified in the TSpec.

7.    Guidance.

a.    Order 8900.1. Changes to Order 8900.1 introduce the standardized curriculum concept for part 135 training conducted by part 142 training centers. New information is incorporated into:

    Volume 3, Chapter 18, Section 3, Part A Operations Specifications—General, OpSpec/MSpec/LOA A031 and OpSpec A131.

    Volume 3, Chapter 18, Section 4, Part B Operations Specifications—En Route Authorizations and Limitations, TSpecs B005, B105, and B106.

    Volume 3, Chapter 19, Section 1, Scope, Concepts, and Definitions.

    Volume 3, Chapter 20, Section 5, Safety Assurance System: General—Part 135 Certificate Holders.

    Volume 3, Chapter 20, Section 6, Safety Assurance System: Part 135 Check Pilot Approval and Surveillance.

    Volume 3, Chapter 54, Section 1, Part 142 Training Centers: Training Center and Training Center Program Manager Overview.

    Volume 3, Chapter 54, Section 2, Part 142 Training Centers: Training, Qualification, and Designation of Training Center Instructors and Evaluators.

b.    Sample TSpec. A sample TSpec B005 template is in Appendix A.

c.    Job Aid. The TSpec B005 job aid is available in the Web-based Operations Safety System (WebOPSS).

8.    Action. A TCPM should only issue TSpec B005 after a training center requests authorization to offer approved curricula, curriculum segments, and portions of curriculum segments applicable for use in training courses required by a part 135 standardized curriculum, and that the TCPM has determined meets the regulatory requirements. TCPMs should use Order 8900.1, Volume 3, Chapter 54, Section 3 for standardized curriculum approvals and Volume 6, Chapter 8, Section 1.

Appendix A. Sample TSpec B005, Special Rule Curricula: 14 CFR Part 142

a.    The 14 CFR Part 142 certificate holder, herein referred to as the “training center,” is authorized, as indicated in Table 1 of this training specification, and as defined by the curriculum, to conduct the aircraft-specific training, testing, checking for aircraft ratings, pilot authorizations, and other training as provided for in 14 CFR Part 135, § 135.324 to Part 135 certificate holders authorized to use this curricula.

b.    The training center is authorized, as indicated in Table 2 of this training specification, and as defined by the curriculum, to conduct the training and checking required by § 135.324 to qualify instructors and evaluators (check pilots) for use in specified curricula in Table 1 for Part 135.

c.    The training center is authorized to conduct the training, testing, or checking listed in Tables 1 and 2 under the following conditions:

(1)    The training center must not provide training, checking, and testing contrary to that which is authorized.

(2)    The training center must utilize the quality control measures, evaluation plans, and recordkeeping required by Part 142, § 142.11(b)(6), (8), and (9), for the recording, delivery, and maintenance of all curricula authorized in this training specification and associated pilot records.

d.    The training center must maintain records for instructors and evaluators (check pilots), identifying the curriculum(s) they are designated to instruct or evaluate and their qualifications to provide training and checking in accordance with § 135.324(b)(4).

e.    The training center must make readily available to Part 135 certificate holders all curricula to be utilized, instructor and Training Center Evaluator (TCE) (check pilot) records, checklists, and maneuvers’ procedures documents used to meet § 135.327(b), by electronic or other acceptable means.
